Pre/Post-marriage Agreements

A Pre/Post-marriage agreement, otherwise known as Pre/Post nuptial agreement, and Cohabitation Agreement is a document setting out the terms agreed by a couple in the event of a breakdown of the relationship and the couple separating.

Such agreements have been widely used around the world and are receiving greater recognition by the Courts of England and Wales.

These agreements are extremely important when considering entering into new relationships which lead to cohabitation/marriage/civil partnership.

Whilst these agreements have been widely used around the world, they continue to receive further recognintion by the Courts in England and Wales. In effect the Courts are now having regard to Pre-nuptial and Post nuptial agreements when deciding on financial distribution in divorce proceedings. Consequently, a Pre-nuptial and Post-nuptial agreement can provide protection to parties entering into these agreements.

Such agreements can be important especially if you are proposing a second marriage and have capital assets and/or children from an earlier marriage or relationship.
